Terms of Service
Please read these Terms carefully before using our website or placing an order. They explain how we serve you, and what we ask of you in return.
01Introduction
Welcome to Brewhaven Café. These Terms of Service ("Terms") govern your use of our website, mobile ordering tools, and our physical café locations, together with any purchase you make from us, whether online, by phone, or in person.
We have written these Terms in plain language on purpose. A café should feel like a warm, familiar place, and that includes the fine print. If anything here is unclear, our team is always happy to explain it over a cup of coffee.
02Acceptance of Terms
By browsing our website, creating an account, placing an order, making a reservation, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please discontinue use of our website and services.
Continuing to use our website after changes are posted counts as acceptance of the updated Terms, as described in Section 32.
03Eligibility
You must be at least 16 years old to create an account or place an order directly with us. Younger guests are always welcome in-café when accompanied by a parent or guardian who takes responsibility for the order. By using our services, you represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms.

05Menu Availability
Our menu changes with the seasons and with the availability of fresh ingredients. Prices, descriptions, and photographs on our website are provided as a guide and may differ slightly from what is served. We reserve the right to add, modify, or remove menu items, including limited-time or seasonal offerings, at any time and without prior notice.
06Ordering Policy
Orders may be placed online, through our mobile ordering tool, by phone, or in person. An order is only considered accepted once you receive a confirmation, as described in Section 10. We reserve the right to refuse or limit any order, including orders that appear fraudulent, unusually large, or placed outside normal operating conditions.
- Please double-check your items, sizes, and customizations before submitting an order.
- Special requests (extra hot, dairy-free milk, etc.) are honored on a best-effort basis.
- Orders placed near closing time may be adjusted based on remaining stock.
07Pricing Policy
All prices are listed in local currency and are subject to change without notice to reflect ingredient costs, seasonal availability, or promotional periods. The price charged will be the price displayed at the time your order is confirmed, not the time you began browsing the menu.
08Payment Terms
We accept major debit and credit cards, approved digital wallets, and cash for in-café purchases. Online and mobile orders must be paid in full at the time of ordering. Payment processing is handled by trusted third-party providers; we do not store full card numbers on our own servers.
09Taxes
All applicable sales, food service, or value-added taxes will be calculated at checkout in accordance with local law and added to your total. Tax rates may vary depending on order type (dine-in, pickup, or delivery) where required by local regulation.
10Order Confirmation
Once your order and payment are successfully processed, you will receive a confirmation by email, SMS, or in-app notification, including an order summary and estimated ready time. This confirmation represents our acceptance of your order and the formation of a contract for that purchase.
11Order Cancellation
You may cancel an order free of charge before we begin preparing it. Once preparation has started, cancellation may no longer be possible, as freshly made food and beverages cannot be resold. To request a cancellation, contact us immediately using the details in Section 33.
12Refund Policy
Guest satisfaction matters to us. If an item arrives incorrect, damaged, or not as described, please let us know within 24 hours of receipt, along with a description or photo where possible. Approved refunds will be issued to your original payment method or as store credit, at your preference, and are typically processed within 5–10 business days.
Because of food safety standards, we generally cannot accept the physical return of consumed or partially consumed items; refund eligibility is assessed based on your description and, where relevant, photos.
13Delivery Policy
Delivery is available within our defined service area and during posted delivery hours. Estimated delivery times are our best projection and may be affected by weather, traffic, order volume, or courier availability. Please ensure someone is available to receive the order at the address provided; we are not responsible for delays caused by inaccurate delivery information.
14Pickup Policy
Pickup orders should be collected within 30 minutes of the notified ready time to ensure the best quality and temperature. Orders not collected within a reasonable time may be donated or discarded in line with our food safety policy, and are not eligible for a refund unless the delay was caused by us.
15Reservation Policy
Table reservations can be made online or by phone and are held for 15 minutes past the booked time. We recommend cancelling or rescheduling at least 2 hours in advance if your plans change, so we can offer the table to other guests. Large group bookings may require a deposit, which will be clearly stated at the time of booking.
16Customer Responsibilities
- Provide accurate contact, payment, and delivery information.
- Treat our staff, other guests, and our café spaces with respect.
- Inform us of any allergies or dietary needs before ordering.
- Review order confirmations promptly and report issues in a timely manner.
17Food Allergies Disclaimer
Our kitchen handles common allergens, including nuts, dairy, gluten, soy, and eggs. While we take reasonable precautions, we cannot guarantee that any item is completely free of allergen traces due to shared preparation areas and equipment. Guests with allergies or intolerances should inform our staff before ordering and use ingredient information as a guide, not a guarantee.
18Hygiene & Food Safety
We follow applicable local food safety and hygiene regulations across our kitchens and café spaces, including regular staff training, temperature control, and cleaning schedules. If you have a concern about food quality or safety, please report it to us right away so we can investigate and respond appropriately.
19Promotions & Discounts
From time to time, we run promotions, seasonal discounts, or loyalty rewards. Each promotion may carry its own specific conditions, which will be stated at the time it is offered. Unless stated otherwise, promotions cannot be combined, have no cash value, and may be withdrawn or modified at our discretion.
20Gift Cards
Brewhaven Café gift cards can be purchased in-café or online and redeemed at any of our locations. Gift cards are non-refundable, cannot be exchanged for cash except where required by law, and remain valid until fully redeemed unless otherwise stated on the card. Lost or stolen gift cards cannot be replaced unless originally registered to an account.
21Intellectual Property
All content on our website, including our name, logo, recipes, photography, and text, is owned by or licensed to Brewhaven Café and is protected by copyright and trademark law. You may view and share this content for personal, non-commercial purposes, but may not reproduce, modify, or distribute it commercially without our written permission.
22User Accounts
Creating an account lets you save favorites, track orders, and earn loyalty rewards. You are responsible for maintaining the confidentiality of your login details and for all activity under your account. Please notify us immediately if you suspect unauthorized use of your account.
23Acceptable Use Policy
When using our website and services, you agree not to:
- Attempt to gain unauthorized access to our systems or another user's account.

25Third-Party Links
Our website may link to third-party sites, such as delivery partners or social media platforms. We do not control and are not responsible for the content, policies, or practices of these external sites. Visiting a linked site is at your own risk and subject to that site's own terms.
26Disclaimer of Warranties
Our website and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our website will be uninterrupted, error-free, or entirely secure.
27Limitation of Liability
To the maximum extent permitted by applicable law, Brewhaven Café shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability for any claim relating to an order shall not exceed the amount you paid for that specific order.
28Indemnification
You agree to indemnify and hold harmless Brewhaven Café, its owners, employees, and partners from any claims, damages, or expenses, including reasonable legal fees, arising from your violation of these Terms or your misuse of our website or services.
29Force Majeure
We shall not be held responsible for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, extreme weather, power outages, supply shortages, labor disputes, or government restrictions.
30Governing Law
These Terms are governed by and construed in accordance with the laws of the state or region in which Brewhaven Café is registered, without regard to its conflict-of-law principles.
31Dispute Resolution
We encourage guests to first contact us directly so we can resolve any concern quickly and fairly. If a dispute cannot be resolved informally, it shall be submitted to the competent courts of the jurisdiction where Brewhaven Café is registered, or to a mutually agreed mediation or arbitration process where available.
